Welcome to Magic Basket. Please read on to learn the rules and restrictions that govern your use of our website(s), mobile app(s), products, services, applications, and other online or offline communications (the “Services”). These Terms of Service (the “Terms”) are a binding contract between You and Magic Basket Laundry LLC (“Magic Basket”, “we”, and “us”). Your use of the Services in any way means that you agree to all these Terms, and these Terms will remain in effect while you use the Services. These Terms include provisions in this document as well as those in the Privacy Policy and any other relevant policies. Your use of or participation in certain Services may also be subject to additional policies, rules and/or conditions (“Additional Terms”), which are incorporated herein by reference, and you understand and agree that by using or participating in any such Service, you agree to also comply with these Additional Terms.

Acceptance of Terms

PLEASE READ THESE TERMS CAREFULLY. THESE TERMS INCLUDE INFORMATION ABOUT FUTURE CHANGES TO THESE TERMS, AUTOMATIC RENEWALS, LIMITATIONS OF LIABILITY, A CLASS ACTION WAIVER AND RESOLUTION OF DISPUTES BY ARBITRATION INSTEAD OF IN COURT. PLEASE NOTE THAT YOUR USE OF AND ACCESS TO OUR SERVICES ARE SUBJECT TO THE FOLLOWING TERMS AND BY CREATING AN ACCOUNT OR USING ANY MAGIC BASKET SERVICE, YOU AGREE TO BE BOUND BY THESE TERM. IF YOU DO NOT AGREE TO ALL OF THE FOLLOWING TERMS, YOU MAY NOT USE OR ACCESS THE SERVICES IN ANY MANNER.

Basics of Using Magic Basket

You may be required to sign up for an account, select a password and user name (“Magic Basket User ID”), and provide us with certain information or data, such as your contact information. You promise to provide us with accurate, complete, and updated registration information about yourself. You may not select as your Magic Basket User ID a name that you do not have the right to use, or another person’s name with the intent to impersonate that person. You may not transfer your account to anyone else without our prior written permission. If you change your contact information, including any mobile number, you agree that you will notify us immediately. 

Additionally, you may be able to access certain parts or features of the Services by using your account credentials from other services (each, a “Third Party Account”), such as those offered by Facebook. We also accept credentials from corporate SAML. By using the Services through a Third Party Account, you permit us to access certain information from such account for use by the Services. You are ultimately in control of how much information is accessible to us and may exercise such control by adjusting your privacy settings on your Third Party Account.

You represent and warrant that you are an individual of legal age to form a binding contract (or if not, you’ve received your parent’s or guardian's permission to use the Services and have gotten your parents or guardian to agree to these Terms on your behalf). 

You will only use the Services for your own internal, personal, non-commercial use, and not on behalf of or for the benefit of any third party, and only in a manner that complies with all laws that apply to you. If your use of the Services is prohibited by applicable laws, then you aren’t authorized to use the Services. We can’t and won’t be responsible for your using the Services in a way that breaks the law.

You will not share your Magic Basket User ID, account or password with anyone, and you must protect the security of your Magic Basket User ID, account, password and any other access tools or credentials. You’re responsible for any activity associated with your Magic Basket User ID and account.

Eligibility & Service Areas

You must be at least 18 years old to use this service. Magic Basket currently operates in designated Houston zones. We reserve the right to refuse service to anyone and expand our Service to any location.

Description of Service

Magic Basket provides a pickup and delivery "wash-and-fold" service. We do not offer walk-in services, commercial-grade processing, or specialized dry-cleaning at this time.

Restrictions on Use of Service

You represent, warrant, and agree that you will not contribute any Content or User Submission or otherwise use the Services or interact with the Services in a manner that:

  • Infringes or violates the intellectual property rights or any other rights of anyone else (including Magic Basket);
  • Violates any law or regulation, including, without limitation, any applicable export control laws, privacy laws or any other purpose not reasonably intended by Magic Basket; 
  • Is dangerous, harmful, fraudulent, deceptive, threatening, harassing, defamatory, obscene, or otherwise objectionable;
  • Jeopardizes the security of your Magic Basket User ID, account or anyone else’s (such as allowing someone else to log in to the Services as you);
  • Attempts, in any manner, to obtain the password, account, or other security information from any other user;
  • Violates the security of any computer network, or cracks any passwords or security encryption codes;
  • Runs Maillist, Listserv, any form of auto-responder or “spam” on the Services, or any processes that run or are activated while you are not logged into the Services, or that otherwise interfere with the proper working of the Services (including by placing an unreasonable load on the Services’ infrastructure);
  • “Crawls,” “scrapes,” or “spiders” any page, data, or portion of or relating to the Services or Content (through use of manual or automated means);
  • Copies or stores any significant portion of the Content;
  • Decompiles, reverse engineers, or otherwise attempts to obtain the source code or underlying ideas or information of or relating to the Services;
  • Threatens our employees, contractors, agents, or other personnel; or
  • Engages in any other act that is offensive or otherwise objectionable.

A violation of any of the foregoing is grounds for termination of your right to use or access the Services.

User Accounts & Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate, current, and complete information during the registration process.

Cost of Service

Our website and app are currently free of charge. We may charge a fee for using the Services.

Paid Services

Paid Services may be subject to payments now or in the future. Subscription plans are month-to-month and may be subject to payments on the date of signup or the 1st of each month. Other options may be subject to payments in the future. See our Pricing Page for a description of our currently offered Paid Services. Please note that any payment terms presented to you in the process of using or signing up for a Paid Service are deemed part of these Terms.

Billing

We use a third-party payment processor (the “Payment Processor”) to bill you through a payment account linked to your account (the “Billing Account”) on the Services for use of the Paid Services. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processor. Currently, we use CleanCloud Pay (offered by CleanCloud) as our Payment Processor. We are not responsible for any error by, or other acts or omissions of, the Payment Processor. By choosing to use Paid Services, you agree to pay us, through the Payment Processor, all charges at the prices then in effect for any use of such Paid Service in accordance with the applicable payment terms, and you authorize us, through the Payment Processor, to charge your chosen payment provider (your “Payment Method”). You agree to make payment using that selected Payment Method. We reserve the right to correct any errors or mistakes that the Payment Process makes even if it has already requested or received payment. 

Payment Method

You agree to pay all amounts due on your Billing Account upon demand if we, through the Payment Process, do not receive payment from you through your Payment Method. 

Recurring Billing 

Subscriptions may consist of an initial period, for which there is a one-time charge, followed by recurring period charges as agreed to by you. By choosing a subscription plan, you are agreeing to a recurring payment plan and you acknowledge that such Services have an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. WE MAY SUBMIT PERIODIC CHARGES (E.G., MONTHLY) WITHOUT FURTHER AUTHORIZATION FROM YOU, UNTIL YOU PROVIDE PRIOR NOTICE (RECEIPT OF WHICH IS CONFIRMED BY US) THAT YOU HAVE TERMINATED THIS AUTHORIZATION OR WISH TO CHANGE YOUR PAYMENT METHOD. SUCH NOTICE WILL NOT AFFECT CHARGES SUBMITTED BEFORE WE REASONABLY COULD ACT. TO TERMINATE YOUR AUTHORIZATION OR CHANGE YOUR PAYMENT METHOD, GO TO YOUR ACCOUNT.

Current Information Required

YOU MUST PROVIDE CURRENT, COMPLETE AND ACCURATE INFORMATION FOR YOUR BILLING ACCOUNT. YOU MUST PROMPTLY UPDATE ALL INFORMATION TO KEEP YOUR BILLING ACCOUNT CURRENT, COMPLETE AND ACCURATE. ANY CHANGES TO BILLING ADDRESS, CREDIT CARD NUMBER, OR CREDIT CARD EXPIRATION DATE MUST BE IMMEDIATELY UPDATED. YOU MUST PROMPTLY NOTIFY US OR OUR PAYMENT PROCESSOR IF YOUR PAYMENT METHOD IS CANCELED OR IF YOU BECOME AWARE OF A POTENTIAL BREACH OF SECURITY SUCH AS THE UNAUTHORIZED DISCLOSURE OR USE OF YOUR USERNAME OR PASSWORD. CHANGES TO SUCH INFORMATION CAN BE MADE IN YOUR ACCOUNT.  IF YOU FAIL TO PROVIDE ANY OF THE FOREGOING INFORMATION, YOU AGREE THAT WE MAY CONTINUE CHARGING YOU FOR ANY USE OF PAID SERVICES UNDER YOUR BILLING ACCOUNT UNLESS YOU HAVE TERMINDATED YOUR PAID SERVICES. 

Auto-Renewal for Paid Services 

Unless you opt out of auto-renewal, any Paid Services you have signed up for will be automatically extended for successive renewal periods of the same duration as the subscription term originally selected, at the then-current non-promotional rate. If you terminate a Paid Service, you may use your subscription until the end of your then-current term, and your subscription will not be renewed after your then-current term expires. However, you will not be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period. If you do not want to continue to be charged on a recurring monthly basis, you must cancel the applicable Paid Service and terminate your MAGIC BASKET account before the end of the recurring TERM. Paid Services cannot be terminated before the end of the period for which you have already paid, and except as expressly provided in these terms, MAGIC BASKET will not refund any fees that you have already paid.

Reaffirmation of Authorization 

Your non-termination or continued use of a Paid Service reaffirms that we are authorized to charge your Payment Method for that Paid Service. We may submit those charges for payment and you will be responsible for such charges. This does not waive our right to seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially selected to use the Paid Service.

Promotions

Any promotion that provides access to a Paid Service must be used within the specified time of the promotion. You must stop using a Paid Service before the end of the promotion period in order to avoid being charged for that Paid Service. If you cancel prior to the end of the promotion period and are inadvertently charged for a Paid Service, please contact us at care@magicbasketlaundry.com. Any and all offers or promotions advertised on the Services are void where prohibited, and are subject to the posting of any official rules to such offers or promotions.

Gift Cards (Future Offering)

Magic Basket may, in its sole discretion, offer gift cards, promotional credits, or similar stored value products in the future. Gift cards are not currently available for purchase or use.

If and when gift cards are made available, they will be subject to additional terms and conditions, which will be incorporated into these Terms of Service by reference and posted on our website. We reserve the right to modify these Terms of Service to include such additional terms at that time.

Your continued access to or use of the Services following the posting of any updated Terms constitutes your acceptance of such modifications, including any terms applicable to gift cards.

Referrals (Future Program)

Magic Basket, in its sole discretion, offer a referral program from time to time that permits users to earn credits, discounts, promotional benefits, or other incentives for referring new customers to the Services. A referral program is not currently active.

If and when a referral program is introduced, participation will be subject to additional terms and conditions, including eligibility requirements, limitations, expiration terms, fraud prevention provisions, and modification or termination rights. Such terms will be posted on our website and incorporated into these Terms of Service by reference.

Magic Basket reserves the right to modify, suspend, or terminate any referral program at any time, with or without notice, and to update these Terms of Service accordingly.

Your continued access to or use of the Services following the posting of any updated Terms constitutes your acceptance of any such modifications, including any terms applicable to a referral program.

No-Customization Policy

To maintain operational efficiency, we do not allow customization of subscription plans. Customers requiring additional capacity may renew their subscription to increase their allotment or use the one-time purchase option.

"As Needed" One-Time Orders

Orders placed outside a subscription are billed at a per-pound rate with a $30.00 minimum charge.

Scheduling

All pickups, deliveries, and rescheduling requests must be submitted by 5:00 PM the evening prior to your scheduled service day.

Pickup & Delivery Days

Customers may request changes to scheduled pickup or delivery dates, subject to availability and our approval in our sole discretion. Requests to modify a scheduled service must be submitted within the timeframe specified on our website or customer portal. We do not guarantee that requested changes can be accommodated.

Magic Basket reserves the right to deny, limit, or reschedule service requests based on route capacity, operational constraints, weather conditions, holidays, staffing, or other business considerations.

Late change requests, missed pickups, failed access, or same-day modification requests may be subject to additional fees, service delays, or forfeiture of service credits, as permitted by applicable law.

Magic Basket also reserves the right to modify scheduled pickup or delivery dates when reasonably necessary due to operational needs, force majeure events, safety concerns, or other circumstances beyond our control. In such cases, we will make reasonable efforts to provide notice and reschedule service.

Your continued use of the Services constitutes acceptance of these scheduling policies and any future modifications thereto.

Customer Responsibility: Pockets & Preparation

Customers are solely responsible for checking all pockets for valuables. Magic Basket is not liable for damage caused by items left in pockets (e.g., pens, lipstick, gum, electronics).

Proper Bag Usage & Overages

Each Magic Basket branded bag is designed to hold approximately 30 lbs of laundry. Bags must be able to close completely. We accept additional bags and any bags over your allotment, will be charged using the As-Needed per-pound rate.

Missed Pickup & Unavailable Laundry

If our driver arrives at the scheduled pickup location and the laundry is not available, accessible, or ready for collection, we will make a reasonable attempt to reschedule the service.

The first occurrence may be treated as a courtesy at our discretion. However, repeated missed pickups, unavailable laundry, or failed access may result in a driver fee of $5.00 per occurrence (or such other amount as we may establish from time to time). We reserve the right to modify the amount of this fee at our discretion upon posting updated pricing on our website or providing notice to you.

Excessive missed pickups may also result in suspension or termination of service.

Unattended Pickup & Delivery (POD)

You agree to leave your laundry in a designated, secure location. Our drivers will take a Proof of Delivery (POD) photo upon drop-off. Magic Basket’s liability ends once the bag is delivered to your designated location.

Standard Wash & Dry Protocols

All laundry is processed using cold water wash cycles and standard machine drying settings. We utilize hypoallergenic, fragrance-free detergent as our default detergent in an effort to minimize potential skin irritation.

Customers acknowledge and agree that laundry care involves inherent risks, including but not limited to shrinkage, color bleeding, fading, fabric wear, and other damage that may occur despite reasonable care. While we use commercially reasonable efforts in processing garments, we do not guarantee specific results.

Stain Treatment Disclaimer

Magic Basket does not guarantee the removal of all stains on any clothing. 

Magic Basket provides basic stain treatment as part of our standard laundry service. We do not guarantee the removal of any stain, including but not limited to set-in stains, oil-based stains, dye transfer, ink, cosmetic products, or other difficult substances.

Magic Basket is not a dry-cleaning, specialty cleaning, or restoration service. Certain stains may be permanent or may require specialized treatment beyond the scope of our Services.

By using the Services, you acknowledge and agree that stain removal results may vary and that we are not liable for stains that cannot be removed despite reasonable care.

Prohibited Items

Magic Basket strictly refuses dry-clean-only items, leather, suede, furs, and any items contaminated with hazardous materials, biohazards, or human/animal waste. Detailed information and examples can be found on Magic Basket’s Knowledge Center.

Damaged Items

Any claims for damaged garments must be submitted within seven (7) days of delivery. We reserve the right to inspect the item to determine if the damage was pre-existing or caused by improper care labels. Notice can be provided through email at care@magicbasketlaundry.com.

Magic Basket is not responsible for any normal wear and tear on clothing that may occur from pickup, cleaning, and delivery process, including loosening or shrinkage, breakage of zippers or certain fasteners, loss of buttons, fading or stains, fatiguing, holes or abrasions. 

In the event that the clothing items that you sent to Magic Basket are damaged due to the fault of Magic Basket, we will work with you and endeavour to rectify the situation provided you submit the claim within the allotted time frame. Under Magic Basket’s sole discretion,  Magic Basket’s total liability for any damaged items is capped at $100. All compensation will be via account credit up to $100 in credits. There is no ability to reimburse via check or via the purchase of a replacement item.

Lost Item Search Protocol

There is an inherent risk in sending garments for cleaning and there is potential for these garments to get lost. Magic Basket has implemented measures designed to prevent the situations of lost items from happening, but Magic Basket cannot guarantee that such situations will never happen.

Magic Basket does not take responsibility for any loose items lost when submitted in a Magic Basket bag, such as but not limited to, watches, jewelry, Airpods, or cufflinks. Additionally, Magic Basket is not liable for items misplaced before pickup or after delivery.

Any lost item must be reported within 7 days of the delivery of the garments. Claims submitted more than seven (7) days after the delivery will not be considered.

When a claim for a lost item is submitted, a Customer Care Agent will be in touch to get a claim started. At this point, Magic Basket will begin a formal investigation which includes review of all the orders tracking information, interviews with employees involved, and an ample search for the missing item(s). While we aim to have this resolved quickly, the detail of the review means it can take up to 21 days.

For any items deemed lost, in the event that the items cannot be found, Magic Basket may reimburse up to $100. All compensation will be via account credit. There is no ability to reimburse via check or via the purchase of a replacement item.

Third-Party Partnership

You acknowledge and agree that Magic Basket may engage third-party service providers or partners to perform certain aspects of the physical processing, cleaning, handling, or transportation of laundry.

While we may utilize such third-party partners, we maintain commercially reasonable quality control standards and oversight procedures intended to ensure consistency with our brand standards and service expectations. However, the use of third-party providers does not create any partnership, joint venture, employment, or agency relationship between you and such providers.

By using the Services, you consent to the transfer and handling of your items by authorized third-party partners as part of the normal fulfillment process.

SMS & Electronic Communcations

As part of the Services, you may receive communications through the Services, including messages that Magic Basket sends you (for example, via email or SMS). When signing up for the Services, you will receive a welcome message. By signing up for the Services and providing us with your phone number, you consent to receive notifications via SMS and email and confirm you want Magic Basket to send you information that we think may be of interest to you, which may include Magic Basket using automated dialing technology to text you at the phone number you provided, and you agree to receive communications from Magic Basket and you represent and warrant that each person you register for the Services or for whom you provide a phone number has consented to receive communications from Magic Basket. You agree to indemnify and hold Magic Basket harmless from and against any and all claims, liabilities, damages (actual and consequential), losses and expenses (including attorneys’ fees) arising from or in any way related to your breach of the foregoing. Note that for text messages you receive through the Services, data and message rates may apply. Any and all such charges, fees or costs are your sole responsibility. You should consult with your wireless carrier to determine what rates, charges, and fees or costs may apply to your use of the Services.

Intellectual Property

All website content, logos, and SOPs are the property of Magic Basket and may not be used without written consent.

User Conduct

We reserve the right to terminate service for any user who exhibits abusive behavior toward our drivers, staff, or partners.

Indemnification

You agree to indemnify and that we are not responsible to you for anything that we may otherwise be responsible for, if it is the result of events beyond our control, including, but not limited to, acts of God, war, insurrection, riots, terrorism, crime, labor shortages (including lawful and unlawful strikes), embargoes, postal disruption, communication disruption, unavailability of payment processors, failure or shortage of infrastructure, shortage of materials, or any other event beyond our control.

Disclaimer of Warranties

Magic Basket provides its service on an "as is" and "as available" basis. We do not guarantee that the service will be error-free or uninterrupted.

Force Majure

Magic Basket is not liable for missed pickups or delivery delays caused by Acts of God, extreme weather, or other events beyond our reasonable control.

Governing Law

These terms are governed by the laws of the State of Texas.

Arbitration Agreement

Please read the following ARBITRATION AGREEMENT carefully because it requires you to arbitrate certain disputes and claims with Magic Basket and limits the manner in which you can seek relief from Magic Basket.

Both you and Magic Basket acknowledge and agree that for the purposes of any dispute arising out of or relating to the subject matter of these Terms and/or Services, Magic Basket’s officers, directors, employees and independent contractors (“Personnel”) are third-party beneficiaries of these Terms, and that upon your acceptance of these Terms, Personnel will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as the third-party beneficiary hereof.

(a) Arbitration Rules; Applicability of Arbitration Agreement. The parties shall use their best efforts to settle any dispute, claim, question, or disagreement arising out of or relating to the subject matter of these Terms and/or Services directly through good-faith negotiations, which shall be a precondition to either party initiating arbitration. If such negotiations do not resolve the dispute, it shall be finally settled by binding arbitration in Fort Bend County, Texas. or, if the JAMS Consumer Arbitration Minimum Standards are applicable, near or in the county in which you reside. The arbitration will proceed in the English language, in accordance with the JAMS Streamlined Arbitration Rules and Procedures (the “Rules”) then in effect, by one commercial arbitrator with substantial experience in resolving intellectual property and commercial contract disputes. The arbitrator shall be selected from the appropriate list of JAMS arbitrators in accordance with such Rules. Judgment upon the award rendered by such arbitrator may be entered in any court of competent jurisdiction. The JAMS Consumer Arbitration Minimum Standards shall apply as required by JAMS. The JAMS Optional Arbitration Appeal Procedures shall apply to disputes and claims having a value of $250,000 or greater.

(b) Small Claims Court; Infringement. Either you or Magic Basket may assert claims, if they qualify, in small claims court in Fort Bend County, Texas or any United States county where you live or work. Furthermore, notwithstanding the foregoing obligation to arbitrate disputes, each party shall have the right to pursue injunctive or other equitable relief at any time, from any court of competent jurisdiction, to prevent the actual or threatened infringement, misappropriation or violation of a party's copyrights, trademarks, trade secrets, patents or other intellectual property rights.

(c) Waiver of Jury Trial. YOU AND MAGIC BASKET WAIVE ANY CONSTITUTIONAL AND STATUTORY RIGHTS TO GO TO COURT AND HAVE A TRIAL IN FRONT OF A JUDGE OR JURY. You and MAGIC BASKET are instead choosing to have claims and disputes resolved by arbitration. Arbitration procedures are typically more limited, more efficient, and less costly than rules applicable in court and are subject to very limited review by a court. In any litigation between you and Magic Basket over whether to vacate or enforce an arbitration award, YOU AND MAGIC BASKET WAIVE ALL RIGHTS TO A JURY TRIAL, and elect instead to have the dispute be resolved by a judge.

(d) Waiver of Class or Consolidated Actions. ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THIS ARBITRATION AGREEMENT MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS. CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER. If however, this waiver of class or consolidated actions is deemed invalid or unenforceable, neither you nor Magic Basket is entitled to arbitration; instead all claims and disputes will be resolved in a court as set forth in (g) below.

(e) Opt-out. You may opt-out of these arbitration procedures and the waiver of class and representative proceedings specified in these Terms and Conditions by sending a written letter to Magic Basket at care@magicbasketlaundry.com within thirty (30) calendar days of your initial agreement to these Terms and Conditions (including your first use of the Services) that specifies: (1) your name; (2) your mailing address; (3) and your request to be excluded from the final, binding individual arbitration procedure and waiver of class and representative proceedings specified in this Section. Please ensure the email is titled “Opt-out of Arbitration Procedures”. In the event that you opt-out consistent with the procedures set forth above, all other terms of these Terms and Conditions shall continue to apply.

(f) Exclusive Venue. If you send the opt-out notice in (e), and/or in any circumstances where the foregoing arbitration agreement permits either you or Magic Basket to litigate any dispute arising out of or relating to the subject matter of these Terms in court, then the foregoing arbitration agreement will not apply to either party, and both you and Magic Basket agree that any judicial proceeding (other than small claims actions) will be brought in the state or federal courts located in, respectively, Fort Bend County, Texas, or the federal district in which that county falls.

(g) Severability. If the prohibition against class actions and other claims brought on behalf of third parties contained above is found to be unenforceable, then all of the preceding language in this Arbitration Agreement section will be null and void. This arbitration agreement will survive the termination of your relationship with Magic Basket.

Modifications of Terms

We reserve the right to update these Terms at any time. Significant changes will be communicated via the email on your account, a notice on our site, and/or notify you by some other means. 

If you don’t agree with the new Terms, you are free to reject them; unfortunately, that means you will no longer be able to use the Services. If you use the Services in any way after a change to the Terms is effective, that means you agree to all of the changes. 

Except for changes by us described here, no other amendment or modification of these Terms will be effective unless in writing and signed by both you and us.
